Terms of service

Hot Leads supplies trained sales reps and the software they call from. Calling people has rules, and some of them fall on us while others fall on you. This page says which is which, in the plainest language we can manage.

01The agreement

These terms are between Limelight International LLC, of 1309 Coffeen Avenue, Ste 2379, Sheridan, WY 82801, United States, trading as Hot Leads, and the business that has signed up for the service. Where this page and a signed order form disagree, the order form wins.

They apply from the moment somebody at your business uses the product, and they cover the website, the application, the API and the work our reps do for you.

02What the service is

Two things, sold together and worth separating here.

  • People. Trained sales reps who call and message your prospects on your behalf, working to your offer and your script.
  • Software. The calling workspace they work in, the compliance gate that decides whether a call may be placed, the lead and campaign data behind it, and a dashboard where you see your own activity.

You see your own organisation and nothing else. That separation is enforced in the application rather than by a filter on a screen: a query that does not say whose data it is reading does not compile. The database holds matching policies as a second line of defence, and our privacy policy is precise about which of the two is currently load bearing. Our own operations staff and the reps assigned to you can see your campaign, because that is what running it requires.

03Accounts, invitations and seats

There is no public sign-up. Accounts are created by invitation, and an invitation is issued by us or by an administrator at your business. You are responsible for who you invite and for telling us promptly when somebody leaves.

Two separate counts sit on your account: the number of reps we have contracted to supply, and the number of people at your business who may log in to the portal. Both are counted from real user records rather than asserted, and our own staff are never counted against your seats. Where a seat limit applies and is reached, further invitations are refused until a seat is freed or the limit is raised by agreement.

Keep your credentials to yourself. Anything done through your account is treated as done by you.

04Your data and your lists

Your data stays yours. The contacts you upload, the activity your campaigns generate, the recordings, the transcripts and the notes all belong to you. We hold them to run the service for you and to keep the compliance records the law expects us to keep.

You can read your data back through the product and through the documented API, using an API key scoped to your organisation. Where you connect your own customer relationship system, the product writes activity into it at your instruction and that data becomes yours to manage there.

When you upload or build a list, you are telling us these people may lawfully be contacted for this purpose. That is a statement only you are in a position to make, because only you know where the list came from and what was said to those people when it was collected. You are responsible for it.

How we handle the personal data of the people you ask us to contact is set out in the privacy policy, which is part of these terms.

05Compliance, and who is responsible

Every outbound call is checked by a compliance gate before it is placed. Nothing in the product can place a call without a passing check, and that is enforced in three separate places so that one of them being bypassed is not enough. The gate checks calling hours in the called party's own local time, resolved from their address rather than their area code, narrowed to whichever of the federal, state and campaign windows is tightest. It checks our internal do-not-call list, an attempt cap, a cooldown between attempts, and the recording rules for the called party's state.

What the gate does not check today

Numbers are not scrubbed against the national Do Not Call registry, state registries or litigator lists. No such scrub is connected to the product. The gate records those three as not checked rather than as passed, tells the rep on screen that the number has not been scrubbed, and writes the same into the audit record. If your campaign needs a registry scrub, speak to us before you start: it is a licensed data source and it has to be bought.

The rules the gate enforces are drawn from vendor documentation and practitioner sources rather than from primary statute. They are what the software does. They are not legal advice, and neither is this page. You are responsible for your own compliance position, for the lawfulness of your list, and for what your offer says. We are responsible for the gate doing what this page says it does, and for the records it leaves behind.

Where somebody asks us to stop, we honour it immediately and across every channel, and it is not reversible from inside the product. You cannot instruct us to contact somebody who has asked us to stop.

06Recording

Some calls are recorded. Whether a given call may be recorded, and whether the audio may be kept, is decided by the software per call against the rules for the called party's state, and cannot be overridden by a rep or by you. In a state that requires all parties to consent, the rep reads a fixed disclosure aloud and confirms it, and without that confirmation no recording is kept.

The full detail, including the exact words the rep reads and what happens to the audio afterwards, is in the recording policy, which is part of these terms.

07Acceptable use

You agree not to use Hot Leads, or ask our reps to, for any of the following.

  • Contacting people you have no lawful basis to contact.
  • Anything deceptive about who is calling, who they represent, or what is being offered.
  • Offers that are themselves unlawful, or that are regulated in a way you have not told us about, such as regulated financial, medical or legal products.
  • Instructing a rep to ignore a request to stop, to skip a recording disclosure, or to misstate what a recording is for.
  • Attempting to reach another client's data, probing the isolation between accounts, or sharing API credentials outside your business.
  • Reselling access to the product without a written agreement to do so.

We will refuse work we think crosses these lines, and we would rather have that conversation before a campaign starts than after it.

08Early access and availability

Parts of this product are new and are being used for the first time. Features may change, and some of what you see is being exercised in production earlier than it has been anywhere else. We will tell you when something you rely on is in that position rather than let you discover it.

We do not currently offer a service level commitment on uptime, latency or answer rates. There is no credit scheme attached to downtime and no guaranteed response time on support. If that changes it will be written into an order form and this paragraph will change with it, rather than being implied by silence somewhere else. We do not promise a number of meetings, a connect rate or a conversion rate, and nothing on our marketing site should be read as promising one. Outbound results depend on your offer and your list at least as much as on the calling.

09Fees

Platform pricing is published: $395 per seat per month, $49 for each additional seat, with a 7 day trial. Staffing is quoted separately and depends on seniority, hours, vertical and list size, which is why it is a conversation rather than a price on a page.

Seats are billed monthly in advance. We invoice: there is no card on file and no self-serve checkout, so nothing is charged automatically and no payment instrument is stored. Invoices are due within 14 days of issue and are paid by bank transfer unless your order form says otherwise. Where an order form and this page disagree, the order form wins.

Prices are exclusive of tax. Any sales, use or withholding tax that applies where you are is yours to pay on top. Because billing is monthly in advance, a part month is not refunded when you leave partway through one: the 7 day trial is the window for deciding whether this works for you, and it exists so that the decision does not have to be made after an invoice. If we have billed you for something you did not get, we will credit it.

An invoice more than 14 days past due may lead to calling being paused on the account after we have told you and given you a chance to settle it. We would rather ask twice than switch off a floor mid campaign.

Where usage based costs such as telephony are passed through, they are shown as such rather than folded into a headline number.

10Suspension and ending the agreement

We may pause calling on an account immediately where we believe a campaign is contacting people it should not be, where a phone number's reputation is at risk, or where a provider requires it. We will tell you why, and we will work with you to fix it.

Either side may end the agreement on 30 days written notice, taking effect at the end of the month in which the notice period expires. You do not have to give a reason.

For 30 days after termination we keep your account's API access live so you can take your data out. Be clear about what that means in practice: the export is the documented API, which returns your leads, your calls and your campaign records. It is not a button in the product, because no such button exists today. Recordings and transcripts are not on that API and we will provide them on request within the same window.

After the 30 days, access ends and the data stays on our systems. We are not going to tell you it is deleted, because nothing in this product deletes it: there is no retention job and no automatic purge, which our privacy policy says at more length. If you want it erased, ask us in writing and we will do it by hand and confirm when it is done. Compliance records, including do-not-call listings and the record of anyone who asked us to stop, are kept regardless. Deleting those is how somebody who asked to be left alone gets called again.

11Disclaimers and liability

We provide the service with reasonable skill and care. Beyond what this page and your order form say, and to the extent the law allows, the service is provided as it is.

Nothing here is legal advice. The compliance gate is a control, not an opinion on your legal position, and you should take your own telecoms advice before you dial at volume.

Each side's total liability under this agreement is capped at the platform fees paid in the 12 months before the claim arose. Neither side is liable to the other for lost profits, lost revenue, lost or anticipated business, or for indirect or consequential loss, however it arises. Nothing in this agreement limits liability that cannot lawfully be limited, which includes fraud and anything else the law puts beyond the reach of a contract.

One exclusion is worth stating rather than leaving to be inferred, because it is the one most likely to matter. You choose who is contacted. If a list you supplied, or a list we built to filters you set, results in a claim about who was called or messaged, that is yours rather than ours. The cap above does not apply to it.

12Changes, law and contact

When these terms change materially we will tell account holders and change the effective date at the top. Continuing to use the service after that is acceptance.

This agreement is governed by the laws of the State of Wyoming, without regard to its conflict of laws rules, and disputes are resolved exclusively in the state and federal courts sitting in Sheridan County, Wyoming.

Questions about these terms go to nooruddin@sellmysaas.io. They sit alongside our privacy policy and our recording policy.
